EFFECTIVE DATE - JANUARY 1, 2011
Congestion Charge
- $1,000 surcharge on shipments with drops or destination in New York City area (zip codes: 100-108, 110-119).
Detention with Power
- 2 hours free time, $100 per hour and $25 for each additional 15 minutes or fraction thereof. Maximum charge is $800 per day. [Also applies to load/unload.]
Disposal
- The trailer must be completely empty after delivery to the final scheduled destination. Any product, pallets, and/or dunnage left in the trailer are subject to a $200 disposal fee plus $2.00/mile.
Equipment Ordered Not Used
- $2.00 per mile from last destination to designated pickup, subject to a minimum charge of $400. Minimum charge for cancellation on a Friday or before a holiday is $1,000.
Load/Unload/Count
- All loads are assumed to be “Shipper Load/Shipper Count” and “Receiver Unload/Receiver Count.” Driver will not assist with the load. Prior arrangements must be made to get the freight loaded/unloaded by the shipper/receiver or third party. Minimum charge for supervising and paying the lumper/third party is $100. Minimum charge for assuming responsibility for the product count is $100.
Mileage Standard
- “The PC Miler” version 4.0 "practical miles" will be used to determine all mileages.
Non-delivery
- When a shipment is tendered for delivery and through no fault of the carrier such delivery cannot be completed as scheduled, a charge of $2.00 per mile, subject to a minimum charge of $300 plus applicable detention rates will apply. If full and final delivery cannot be accomplished, a lien may be placed on the goods and the goods may be put into storage to offset linehaul, detention, storage, and any other applicable fees. Minimum charge for obtaining a lien is $500. The goods may be sold to offset the lien.
Overloaded
- Maximum load limit is 40,000 pounds. Our trucks are equipped with axle-load gauges. If a shipper loads the truck over the stated 40,000 pound maximum load limit so that a trip to an industry recognized scale is necessary and if the truck is found to weigh over the maximum legal weight limit of 80,000 pounds and the truck needs to return to the shipper to have product removed, a fee of $1,000 will be assessed at that time. The truck will not return to the shipper’s dock until the $1,000 is received in the form of an industry recognized method of guaranteed payment such as a Comchek. The goods may be placed into storage and a lien may be placed on the goods to offset fees.
Payment Terms
- Payment is due within 30 days of the faxed proof of delivery date. Payments post-marked 30 days after the faxed invoice date are subject to a late fee of $100 per freight bill plus interest at the rate of 1.5% per month. Offsetting of freight charges will not be permitted.
Reconsignment
- $200 charge plus applicable linehaul fees; if returned to place of origin, the rate will be $2.00 per mile with $500 minimum. All other fees may apply.
Released Value
- Carrier will not be liable for losses in excess of $100,000.
Stops in Transit
- $200 for each additional stop.
Surcharge for Fuel
- Extraordinary fuel costs will be recovered by the Carrier through a Fuel Surcharge using the Department of Energy national average base index of $1.109/gal. and the industry standard of 6 miles/gal. Revisions will occur on Tuesday following the Monday the index is posted. Fuel surcharge is determined by subtracting the base index from the actual cash price and dividing by a mpg of 6.
Viewing the Loading/Unloading Process
- We reserve the right to be present on the dock at the rear of the trailer to view the loading/unloading process in order to insure that no damage occurs to the equipment.
